Rahul Gandhi Dual Citizenship Case: The Lucknow Bench of Allahabad High Court on Friday said the allegation that Rahul Gandhi, the Leader of the Opposition in the Lok Sabha, holds dual citizenship requires an inquiry.
In its directive, the court ordered the police to file an FIR against the Congress leader and instructed the Uttar Pradesh government to either conduct the investigation itself or refer the matter to a central agency.

The order came while hearing a petition filed by BJP worker S Vignesh Shishir, who challenged a January 28 order of a special MP/MLA court in Lucknow that had rejected his plea seeking the registration of an FIR against the Congress Leader.
Earlier, the special court had held that it lacked jurisdiction to decide issues relating to citizens.
The petitioner, a resident of Karnataka, sought an FIR and a detailed investigation, levelling allegations under the Bharatiya Nyaya Sanhita (BNS), the Official Secrets Act, the Foreigners Act, and the Passport Act, according to a NDTV report.

The case stems from a complaint citing documents and some emails of the British government that show the Congress leader holds UK citizenship. According to the petitioner, these records prove that Rahul Gandhi is a British citizen, a status that would make him ineligible to contest elections in India or hold a seat in Parliament.
The complaint was initially filed before a special MP/MLA court in Rae Bareli. However, the matter was transferred to Lucknow on December 17, 2025. After the Lucknow court refused his plea, citing a lack of jurisdiction to decide issues relating to citizens, the petitioner approached the high court.
Taking note of the concerns raised, the Allahabad High Court said that the matter requires inquiry, directing the Uttar Pradesh government to either conduct the investigation itself or refer the matter to a central agency.
